Received VM from Walter Brice from "Mandatory Arbitration" regarding a returned item from my bank. Did not leave any information identifying about me such as an account number or even my name. Stated I had 48 hours to resolve this complaint (this is the third call I've received in 9 days.) Failure to comply would result in the complaint being formalized in my county.
Doesn't sound legit at all and based on all other info I've found online, this appears to be a scam of some sort.

Another scumbag collection agency illegally telling people they are in trouble and are about to be sued. THIS IS ILLEGAL. Auto-dialed calls violate the TCPA. 3rd party debt collectors cannot sue. This threat violates the FDCPA

Press 9 to reach them. Then a stupid rep would find out the number and your id/name does not match. They will then take your number off the list.

All I confirmed was my phone number (they had that already) and that my name was not what they have listed under that phone number.

I hope this helps. If anyone knows of a way to find where that company is located and what we can do for making them pay for their harassment, spread the word.

Caller name: Pre Trial Resolutions

Caller type: Scammer/Fraudster

Today I figured out this scam because I just happened to be gone and my machine picked up both calls. They work together. DSS Debt Solutions Services 855-673-5298 and Pre Trial Resolutions 888-278-8565 John Spencer. The first call is from DSS around 11 AM today 3/31/2014, then three hours later Pre Trial Resolutions aka John Spencer with a case file and 48 hour warning. I started out with DSS, called them first to see if I could find out why they were calling my deceased son after 16 years of being dead. It was for a car loan with Capital One in 1975 when he got a loan bought a car and then told Capital One to come get it and repossess it. My son was born in 1966 so at the age of 9 he took out a loan for a car and actually bought a car???? That was 39 years ago and in my state you have only 5 years to collect a debt on a contract and 3 if it is just an unsigned loan. Then they changed their story to it must have been my husband who does not have the same name as my son. However they had the last four digets of his SS #. We never defaulted on any loan ever and pay cash for most things including cars and houses. She informed me no matter what I said, they were turning it over to the county where I now live and it would go to court and we would be sued. I said well we will not be there so good luck to you and hung up. Then I called the John Spencer number who it turns out is the second half of the scam, once you are told you will be sued, you are supposed to be sooooo scared you will quickly do what ever John Spencer says including paying him some huge amount of money to keep the thing out of court. I just laughed when they told me this and hung up.

Automated message from John Spencer at Arbitration Resolution regarding case number 2014-###### and possible litigation again me. Suggested that I press 9 for a representative or call 888-278-8565 within 48 hours to get it handled. I called the 888 number (even though my caller ID showed a local number) after blocking my call, the number rang several times and went to a voice message asking me to leave my name and number. HAH! I don't think so! I think it must be a scam... I reported it to a local investigative agency...maybe they will come up with something.

Got a call, as other have reported from John Spencer... leaving me the same message as everyone else has stated.. So I will not repeat..
I called back and I asked for an address and I was immediately put on hold and transferred to another "agent" Naomi... seems to be the same people mentioned above... how coincidental. :) Naoimi comes online and I tell her I need an address and she puts me on hold as well... hmmm... then she comes back and says... how can I help you, you need an address? Well do you have a case with us? I politely said, I do not know what I have with you all, I just keep receiving calls from this number and I tend to deal financial matters in person, so I need an address... and she got hostile with me and and said... in a VERY GHETTO voice/tone...
IF YOU KEEP GETTIN CALL HANG UP THEN BUUUYYYYEEEEYYY... omg. seriously. I am reporting this to the police department.
So good luck to you as well, Naoimi, and your boyfriend... and who ever the h**l John Spencer is... sheesh

Received an automated message saying "Hello, My name is John Spencer. I'm calling from Mandatory arbitration in regards to possible litigation pending against you. When contacting our office. Please have your case number available. 2013 dash 104997 You have 48 hours to resolve this issue. Press the 9 key to speak to a Claims Processor, or call us back. At (888) 743-9314 failure to comply will result in the complaint formalize, with your residing County. Thank you and good luck."

The call came from 214-272-2123. I called that number back and a woman answered the phone saying "Pretrial hearings" I asked what number was this? She got very irate with me because I wouldn't answer if I had a case. Then I said wow, a minute ago your company was Mandatory arbitration when I called before, so which is correct. She hung up the phone. I called again, changed my voice, then gave them a made up case number. They immediately assumed I was that person, but when I wouldn't confirm if I was that person, they got mad and hung up phone.

So, I figure, since they harass me by phone, I will harass them. Call them and ask them for personal information about their bank accounts, debts, and how they intend to pay, etc.

When I told them that this conversation was being recorded, they hung up (typical of scammers when they know they are being recorded). Multiple repeated calls back could not get a real person. They also have access to generic local numbers when they call you to make it look more legit. Also, if you press 0 when calling back, you can get an automated response system. You can enter a persons name and get their direct extension, but alas, no "Spencer" is in their phone book. Appear to be a scam.

I pressed 9 and spoke with a Niamah who said she was a para legal for Walter Price and John Spencer. She said it was for a Chase Manhattan Bank that was written off on my credit report in 2003. I told her that the statute of limitations had run out on that debt, she said they did not care they were still filing and that my court date was scheduled for January 3rd.. I then pointed out that I had filed for bankruptcy and gave her my attorney's name and my case number. She gave my attorney until 3:00 pm today to call back with the case number. My attorney is on vacation out of town until the second, so I don't see that happening. I then called both the district and circuit court clerks in my county and found that there is nothing scheduled for me.

We have been receiving the same calls for a few weeks now. Every couple days 'John Spencer' calls, leaves a case number and wishes us 'good luck'. We have also received a call with a different recording stating legal papers were to be served either at our residence or place of employment, and someone needed to make themselves available with 2 forms of ID and a supervisor would have to sign as a witness. No one has showed up at any time. There's no outstanding debt, nothing on credit reports, all bills are paid. I added the spoofed local number they use to call to a block list. Hopefully they move on. Scammers.

I finally was able to reach a representative to have my number taken off. It was not exactly a sales call, but it has been a major annoyance. The rep was extremely rude. Promptly ended the call with happy holidays I hope Santa brings you some sense.
