Who Is Portfolio Associates Recovery LLC?

It is a publicly traded company with an average stock price of around $57 a share (known as PRAA on NASDAQ). In addition to owning Portfolio Recovery Associates, PRA Group, Inc. also owns several subsidiaries including MuniServices, LLC, PRA Receivables Management, LLC, and PRA Holding I, LLC. The founder of PRA Group, Inc. is Steven D. Fredrickson. He co-founded PRA Group, Inc. in 1996 and has served as its Chairman, Chief Executive Officer, and President since March 2002. The other co-founder, Kevin Stevenson, currently serves as the company's Chief Financial Officer.

What Types of Debt Does Portfolio Recovery Associates Purchase?

Portfolio Recovery Associates purchases several types of debt from various companies and entities throughout the United States. Most debts are delinquent unsecured debts that have been charged off by the original creditor such as credit card debt, medical debts, and personal loans. The company also purchases a large number of debts that are included in Chapter 13 bankruptcies.

Portfolio Recovery Associates pays the creditor a percentage on the dollar for the delinquent account. The creditor benefits by receiving some of the debt that it has charged off as bad debt and believes that it will never collect from the individual. Portfolio Recovery Associates benefits by receiving the account for less than is owed on the account with the intention of collecting the full amount owed from the individual thereby making a profit on the purchase. In order for this to be profitable for Portfolio Recovery Associates, the company must aggressively pursue collections efforts against each account.

Complaints Against Portfolio Recovery Associates for Unfair Collection Practices

The Better Business Bureau reports that during the past three years, 1,311 complaints were closed through the BBB. Of those complaints, 1,169 complaints were due to billing and/or collection issues. An alert on the BBB's website refers to a settlement by Portfolio Recovery Associates, LLC with the State of New York regarding allegations that the company violated New York laws in its debt collections practices. N.Y. Attorney General Eric Schneiderman said, "Debt collectors must follow the same rules the rest of us do when bringing lawsuits -- in this case, suing for debts that were not enforceable in the first place."

Portfolio Recovery Associates often files lawsuits on debts that are too old to collect in an attempt to "scare" individuals into paying these debts even though there is no legal obligation on the part of the consumer to repay the debt due to its age. The company has agreed to pay $475,000 in penalties.

Portfolio Recovery Associates is also facing more problems as the Consumer Financial Protection Bureau (CFPB) investigates the company to determine if it has violated provisions of the Fair Debt Collection Practice Act. According to the CFPB, more than 11,000 complaints were filed between July 2013 and January 2014 against various debt collection companies, including Portfolio Recovery Associates. PRA ranked third for having the most complaints.

Another class action lawsuit is pending in the U.S. District Court in California from 2011. Plaintiffs claim that Portfolio Recovery Associates violated fair debt collection laws by using an autodialer to contact consumers on their cellphones. The Fair Debt Collections Practices Act sets forth the actions that a debt collector may not use in an attempt to collect a debt. Other provisions of the FDCPA include:

A debt collection cannot contact you before 8am or after 9pm unless you give the company permission to do so.Debt collectors cannot contact you at work if you inform the company you cannot receive calls at work.The use of threats of harm or violence is prohibited.Callers cannot use obscene or profane language.Repeatedly calling a person to harass or annoy that person is prohibited.Debt collectors cannot say that you can be arrested if you do not pay the debt.Debt collectors cannot misrepresent the amount you owe, falsely claim that you committed a crime, state they are a government official or calling from a government agency, or state that the papers they are sending or have sent to you are legal forms if the papers are not legal forms.Debt collectors cannot contact you by postcard, use a false company name, or give false credit information about you to a credit-reporting agency.A debt collection company cannot publish a list of names of people who have not paid their debts.

There are other provisions of the Fair Debt Collections Practice Act that an attorney can review with a consumer if the consumer believes he or she is being harassed or threatened by a debt collection company such as Portfolio Recovery Associates. Consumers have several courses of action they can take to stop creditor harassment and hold the company responsible for its unfair collection practices.

That company is 100% scam. They send me in the mail and I checked it out and what is this? Probably a debt collector wants me to pay $462.82? Really? And other thing I did not own Capital One. I tell my parents for what's going on, My mom was shocked. She said to me "Did you own a Capital one?" I was said "No I did I only have American Express serve, Card dot com and Walmart Moneycard, That's all." That company is a Scam! And one more thing, Why in the world's name they tried to sue me for? They suing me just for nothing. So s***w Portfolio Recovery Associates LLC. -_-

This company is a scam & should be federally prosecuted, they have called multiple times a day from bogus numbers, texted me, & threatened me regarding a fictitious payday loan they say I took out 14 years ago for the last 10+ years even going so far as to mail me fake legal documents requesting a settlement payment. I am certain these fraudsters convince some people to pay fake debts with these tactics. This is wrong, these filth are allowed to harass people for decades with no repercussions. Something should be done about this fake company.

So I owe debt to Portfolio Recovery Associates LLC. They ended up sending me something in the mail about a court order from Johnson Mark debt collection. I called Johnson Mark up and we made arrangements to get things paid off quickly. I had been making payments of $65 each week for two weeks then after that would be $32 every week. I had been doing so and had ask before that, "Is there going to be any legal action on my part because I don't want to get sued?" That said no as long as I make the payments and keep in contact with them if something goes wrong that they would not go any further.

This company is the worlds worst ever!!! 4 years ago I was paying on a CareCredit acct. I had to quit work because I had chronic COPD and couldn't work anymore... went on disability. These people called and kept calling even after they took me to court. I let them know I was on disability but they insisted that I pay what I owed... wanted me to agree to a small amount every month. They will harass you to no end. I'm so sick of their calls several times a day and always from a different # and state!!! This company is a third party that "buys" people's accounts when the debtor doesn't want to fool with trying to collect it. They can kiss my butt! I'm sorry about the debt but I live on disability now... It doesn't matter that I paid on this account religiously before having to quit work. Not happy with these people at all! They never stop!!!

These scumbags are breaking the law on so many state & federal levels - I received a default judgement because I never received my summons to court. My mailing address has been the same my entire d**n life! But I didn't even find out about it until five years after the judgement when these pigs show up to collect 40% of my wages (yeah, definitely NOT applying for credit ever again. The credit industry can eat my ENTIRE **!). They garnished me when I was already desperately broke, scraping by trying to support my family- newborn baby at home. Here's the kicker though- the judgement was for a debt that was well beyond the SOL!! What kinda judge grants a default judgement for an expired debt??? I finally paid those scuzzy ** off via garnishment & IN ENTIRETY, went on with my life & then got ANOTHER BILL about 6 months later, paired with what I presume was a fake garnishment court doc or something.

Complaint Filed With The FTC: Xfinity/Phone #s. Xfinity influences COLLECTION AGENCIES to BADGER your/our home phone! How many times a day/week do you get phone calls from the likes of CBE GROUP, Diversified Consultants, Sallie Mae/Navient, MIDLAND CREDIT, Portfolio Recovery? If you're an Xfinity (Comcast) customer I bet you're up to your ears! It would be interesting to see how many people who have Comcast (Xfinity) as their phone carrier receive the bulk of these pest-calls. Xfinity must be reissuing the phone numbers of their former deadbeat customers. These 'formers' are probably in collection status. New phone customers are issued those same numbers by Xfinity and then they become the 'red meat' badgered by the myriad of collection agencies! What the FTC doing for us? SOMETHING? ANYTHING? Let's yuck it up! It's our tax money! The FTC is worthless! -- Just like the former president!

Portfolio Recovery has resorted to illegal practices! I do NOT have any debt payment arrangements with them whatsoever, nor have I ever even spoken to any of their employees. Yet they are now reporting "missed payments" on my credit report. They have now done this twice, but they were 6 months apart! I'm reporting this to the state attorney generals office, as well as the BBB and the FTC. If you are also getting this done to you, PLEASE report them for it! They can't be allowed to break the law at our expense!

These people have been calling me for months, sometimes twice a day. I have answered two or three times but no one is ever on the line. I have no unresolved debt, my credit score is in the 800's. I've blocked so many phone numbers I've lost track. Every time I get one blocked they call from another state with a new phone number. Why can't these idiots be stopped? This is pure harassment.

I really wish I could give this company a rating of negative infinity stars because they are just awful. For an unaccredited company with a shady personality, PRA sure knows how to terrorize and harass everything with a pulse to obtain money; that doesn't even actually belong to them. The audacity. I am a college student, currently away from home, and my parents were the ones to be served. I absolutely despise their tactics to latch on to people for their own gain. I did not even hesitate to file my response with the court. I mean, you send the deputy to my door and you have the nerve to not include any sort of financial documents, or even a warning? The summons is vague and I just must say, not only do I not owe a penny to PRA, the "debt" they are proclaiming that I have was in 2016.

I literally tried to resolve a small debt, they gave me nothing but trouble and harassed me for months. I called with a financial advisor on the line and was still denied help! The employees use scare tactics and threaten to sue me. This company would yield 0 stars but I can only give one. I wish everyone luck when trying to deal with this collection agency! Capital One should be reprimanded for utilizing a collection agency like this one!

They kept calling me on a debt they claim was from Wells Fargo. Some from 1999. This was in 2012-2015. Called almost every day, so I got a phone that blocked their calls, then they started with mail. There was no explaining to them that the statute of limitations was four years in California, and not only had we been with Wells Fargo since 1983, we had a Visa Platinum Card, and our mortgage was with Wells Fargo. Nor did they understand when I told them to pound sand! I guess there enough numbnuts out there that do fall for it, they continue and hope they can fish another one.

For the last year, these people keep calling and misgendering me on recorded lines. I have made it clear that they do not have permission to record me, but they continue. I owe the debt that they are trying to get me to pay and have made it clear that I am happy to pay it, but I have simply asked them to put me on unrecorded lines. They say that they can do this, put me on hold to get an unrecorded line, and then after 10 minutes they always tell me that they will "have to call back on an unrecorded line later".

Received a call today regarding accounts in collections. I admit to the debt, but the agent who took the call, after someone called and didn't leave a message could not answer my questions. She self reported in her script that Portfolio COULD NOT report to the credit union, nor could they sue for the debt. I asked the lady why it was on my credit report if they were not granted permission to report to credit bureaus based on their company policy. No response. Sticking to the script. She advised that I should dispute my credit report, she then proceeded to get her supervisor on the phone after I told her I had recorded her statement and would be disputing.

These company calls daily and never leaves a voicemail. I tried answering the call twice and no one speaks. I have filed a complaint with FCC, but have received no response. I have blocked the numbers of each call, but they continue to call use new phone numbers.

These people are the worst ** ever. Over a micro-sum of $400 borrowed from Target on their opening credit card 8 years ago, PR has been plaguing me all this year almost every day, 2 or 3 times a day. I have never experienced any other company so persistent other than Target themselves after I couldn't pay it back initially on losing all our income for several years. I blocked them on my phone and yes their calls continue. How many numbers do they have to harass us over those $400? I am the wiser having read the other reviews here and will continue to block their numerous phone calls.

Debt collectors. They called me today. I don't answer calls I don't know. Everyone needs to be aware that this company has been fined by the Consumer Financial Protection Bureau. Everyone needs to file complaints with this place. They are violating their agreement. And also file complaints with your attorney general's office in your state. Also record every conversation you have with these people. Get incoming and outgoing call abs for your phones. These abs record every call made by you and every call coming in to you.
